Determing Alimony

If you have been the primary financial provider for your family, it is possible that you will have to make alimony payments.  

In many states, there is no hard and fast method of calculating alimony payments. And to be quite frank, estimating what a judge may do is often fruitless. 

Because the laws of many states allow so much judicial discretion in calculating alimony, the methods and manners for determining whether alimony is appropriate and/or how much alimony should be paid may vary from court to court.

Let me provide you with a typical case study:

Husband and Wife met in college. Both graduated from college with bachelor’s degrees in accounting. They married after graduation when Husband was 23 and Wife was 22 years old. Both parties began working in accounting immediately after graduation. 

Wife stopped working at the birth of the parties’ first child and has been a stay at home mom since. Husband is now 35 years old and earns approximately 6,000.  Wife is 34 and stays at home with their two young children.

Question: Will Husband have to pay alimony? How much? For how long will have to pay?

Answer: Yes, Husband will likely have to pay alimony and the answers to the remaining questions may vary depending on a number of factors. 

The court will generally consider such factors as:

Marriage length: In cases where the parties have been married for less than five (5) years, it is unlikely that a court will award alimony on a final basis, at least in the state I practice in, Georgia. That does not, however, mean that there is an absolute rule that there is no alimony award for short marriages, nor does it mean that temporary alimony may not be awarded

Financial resources of each party: The court will consider whether Wife has financial resources other than Husband’s income with which to support herself.  For example, if Husband did provide the financial support for the family, but Wife had a million savings account that had not been touched during the course of the marriage, the court may not choose to award alimony to Wife because she has resources off of which she may support herself until she acclimates herself into the workforce.

Time needed to acquire training or education to re-enter the workforce: The court definitely contemplates how long it will take Wife to get herself into the work force. In the scenario mentioned, Wife earned a bachelor’s degree and gained some work experience. However, it has been many since she was last employed. 

In today’s economy, it is extremely difficult to find work, even when your most recent experience was just a few months ago. The courts do recognize the difficulty in obtaining work and will contemplate this in alimony awards. 

A high unemployment rate makes it undeniable that getting work is difficult. Plus, the high unemployment rate does not include people like Wife, who are voluntarily not working. This number is the percentage of people who are looking for work and cannot find it.  The court will likely allow somewhere between three and seven years of alimony payments in the scenario above.

Each spouse’s earning capacity: In the scenario above, Wife has the ability earn at the rate of a professional. She has a bachelor’s degree and some work experience. She, however, certainly does not have the earning capacity of Husband given that Husband is currently in the work force and has been for many years. 

Some judges will equalize the parties’ income (before the consideration of child support) and then allow for a drop down of the support after time periods allowing for Wife to re-establish herself into the workforce.

Contributions to the marriage: The courts definitely consider a stay at home spouse’s work toward supporting the house.

A court can order temporary alimony while the divorce is pending. Most alimony is ordered for a specific length of time. Though conduct can bar permanent alimony, it is possible for the court to enter an award for temporary alimony, even when conduct may otherwise not order it on a permanent basis.

So if you have been the primary provider for your spouse and children and your spouse is not able to support herself, you probably will have to pay some form of spousal support.

I have seen on the news these past few years a very disturbing trend. This trend is alarming because of who is involved – primarily men who have earned our trust in very high and powerful positions in the government of their state or of our country. The trend is devastating to families – not just wives but children of all ages. It wrecks families and friends and trust of the constituents who elected these powerful, brilliant men of all ages. These men, who were once bright stars, heroes, role models, people sought after for trusted advice and counsel have since fallen.

Fallen to stations so low that most of us are happy to have nothing to do with them – once respected, now pitied. The trend? Misuse of their role as trusted husband and caregiver to not just their families but the very people who elected them. And how is this mistrust manifest – in their choice to have an affair with a woman who has nothing to do with their sacred marriage ceremony. Adultery. Oh how far they have fallen in that one act violating so many for a few moments of pleasure. I have yet to see one of these fallen heroes who has not shed tears of unhappiness while admitting their grave and selfish lack of propriety and fidelity in their marriage. Typically they are surrounded by family – by wives who seek to support them with broken hearts. Tragic. Unnecessary. Sad. All but unrepentable.

What happened when these leaders first slipped on their men’s wedding band and took an oath of unity and love and togetherness? Have they forgotten the many times they have looked and touched and remembered their love and relationship just at the touch of their men’s ring? Have they forgotten the hours of sacrifice of the devoted woman who stood by their side? Who gave birth in pain to their children – who forgave them for working late and for the times when harsh words were spoken in haste or in anger? Oh to take it all back – to feel the touch of their special men’s wedding band one more time and to remember and to take courage and to resist the urge to do something that would haunt them for the rest of their lives.

For those of us who have not fallen, who have remained strong, who have remembered … may we judge less and be more thankful for those who have consented to stay with us through thick and thin, through the good and the bad. To love us for who we are and for what we are trying so hard to become and can become with their love and support. May we touch the ring on our left hand and remember to love and to cherish for as long as time shall last. Oh help us to remember and to remain forever strong – for the sake of our families and our country. Because strong families make a strong nation! I was a bit surprised to see him fit in so well with the girls, but his remaining sober while they drank made for a good dynamic. Prior to its airing on CBS, the pilot episode was distributed on iTunes free of charge. The show premiered September 24, 2007, and was picked-up for a full 22-episode season on October 19, 2007.The thin white geek was the star of every scene, and it felt like everyone else was only hovering in his orbit, which was fine, because he’s brilliant. And he did the Cha-Cha. And he tried to match wits with a rude smoking monkey, which sounds like a tired sitcom set-up but proved to be worth a laugh or twelve.

This was a good thing because Amy’s night of drinking caught up with her, giving her a vomiting fit. Sheldon ended up taking Amy’s advice to “fight dirty” dealing with Priya. After the strike ended, the show was picked up for a second season airing in the 2008-2009 season, premiering in the same time slot on September 22, 2008.

Ca-razy indeed! Amy was finally able to plant one on Sheldon’s face later on at her apartment (after he apparently wooed her with some skilled dancefloor boogying). As Season 4 wraps up, it would be interesting to play Howard and Bernadette’s marriage plans against Leonard and Priya breaking up.David Saltzberg, a professor of physics and astronomy at the University of California, Los Angeles, checks scripts and provides dialogue, math equations, and diagrams used as props.

I liked that the show kinda sorta addressed the sexual tension (or lack thereof) surrounding ShAmy. It was a little disappointing to see that things didn’t progress beyond the kiss, but it makes sense to take baby steps with the Sheldon character, especially when introducing him to new concepts like physical contact with the opposite sex. After learning that Bernadette is thinking about breaking up with Howard, Penny tells Amy in confidence. Amy, however, decides to tell Sheldon, who tells Leonard, who tells Priya, who tells Raj (who, we learn, has a massive crush on Bernadette).

‘Allure’ continued their annual tradition of celebrity nudes tastefully done, with Kaley Cuoco of ‘The Big Bang Theory’ appearing in this year’s issue. She talked about the shoot on ‘Lopez Tonight’ (Weeknights, 12AM ET on TBS) and seemed quite confident and comfortable in her decision to do it.Unfortunately, that confidence didn’t come on early enough or strongly enough for her to tell her parents about it before the issue hit stands.Actually, she did tell them she was doing a photo shoot for ‘Allure’ magazine, she just neglected the nude part.
